Acceptance of these terms
By creating an account or using Rastros at https://rastros.app, you agree to these Terms of Service. If you do not agree, do not use Rastros.
Rastros is operated by GBS Tecnologia LTDA, a Brazilian limited liability company (sociedade empresária limitada) registered in Brazil ("we", "us", "our"). You ("you") are the natural person using the service.
What Rastros is
Rastros is a service for organizing personal travel content — books, GPS routes, photos, videos, notes — and optionally sharing them via private links. It is provided as-is on a subscription model with a free tier and paid plans.
Your account
You are responsible for keeping your account credentials secure. Any activity under your account is your responsibility. You must be at least 16 years old to use Rastros (or the higher age required by your jurisdiction).
We may suspend or terminate accounts for violations of these terms, including (without limitation) illegal content, copyright infringement, harassment, scraping, or abusive use that affects the service for others.
Your content
You retain ownership of everything you upload to Rastros — photos, videos, notes, GPS tracks, descriptions. By uploading, you grant us a limited, worldwide, royalty-free license to host, store, transmit, transcode (e.g. resize images), and serve your content solely for the purpose of operating the service for you and the people you share it with. We do not use your content for advertising, training third-party AI models, or any purpose unrelated to running Rastros.
You are responsible for the legality of what you upload. You confirm you have the rights to anything you publish, and you grant your shared-book recipients permission to view it.
Subscriptions and payments
- The free tier and paid plans are listed at https://rastros.app/subscription.
- Paid subscriptions are billed by Stripe, Inc. on our behalf. Stripe's own terms apply to the payment transaction itself.
- You can cancel a paid subscription at any time. Cancellation takes effect at the end of the current billing period; no pro-rated refund.
- We may change prices with at least 30 days' notice; existing renewals at old prices are honored until the next renewal.
- If a payment fails, we retry per Stripe's standard schedule before suspending paid features.
What happens to your data when you cancel
Cancelling a paid plan does not delete your content — it locks the rows that exceed the free-tier limit. You can re-subscribe at any time and the locked content becomes accessible again. If you delete your account entirely, your content is erased per our privacy policy.
Acceptable use
You agree not to:
- Upload content that is illegal, infringes intellectual property, or that you do not have the right to share.
- Use Rastros to harass, threaten, or impersonate other people.
- Attempt to circumvent feature limits, scrape, or otherwise misuse the service.
- Use automated scripts to upload bulk content unless explicitly allowed (e.g. our GPX/FIT importer).
- Resell, sublicense, or commercially exploit access to Rastros without our written agreement.
We may remove content or terminate accounts for violations.
Copyright and DMCA
If you believe content on Rastros infringes your copyright, send a notice to [email protected] including:
- A description of the copyrighted work.
- The URL or identification of the allegedly infringing material.
- Your contact information.
- A statement of good-faith belief that the use is not authorized.
- A statement under penalty of perjury that the information is accurate and you are authorized to act.
- Your physical or electronic signature.
We respond promptly. Repeat infringers will have their accounts terminated.
Service availability and warranty
Rastros is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure operation. We make reasonable efforts to keep the service running, take backups, and notify you of significant outages.
Limitation of liability
To the maximum extent permitted by law, Rastros's total liability for any claim arising from the service is limited to the amount you paid in the 12 months before the claim, or R$ 500, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost data, lost profits, or loss of goodwill — even if we have been advised of the possibility.
If you are a natural-person consumer (under Brazil's Consumer Protection Code, EU consumer law, or equivalent rules elsewhere), nothing in this clause limits liability for death, personal injury, gross negligence, willful misconduct, or any damages that cannot be limited under applicable mandatory law.
Governing law and jurisdiction
These terms are governed by the laws of Brazil. Any dispute that cannot be resolved by good-faith discussion will be submitted to the courts of the state of Pernambuco, Brazil.
If you are a consumer in the EU, this clause does not deprive you of the protection of the consumer law of the country where you reside.
Changes to these terms
We may update these terms from time to time. Material changes will be announced at least 30 days in advance via email and a notice on the service. The Effective date at the top of this page reflects the current version. Continuing to use Rastros after a change means you accept the new terms.
